Single Licence Model
This End User License Agreement (EULA) is a legal agreement between you (or the entity you represent) and Bastarda Type S.A.S. It applies to all Bastarda Type fonts you download or purchase. By downloading, installing, or using the font software, you agree to be bound by the terms of this license. If you do not agree with these terms, please do not download, install, or use the fonts.
Font Software implies the software in source code form which is accompanied by this agreement and generates typographic designs when using the appropriate hardware and software.
Use refers to any activity to reproduce the acquired Font Software or type family. You get the right to embed it on desktop computers, websites, servers, EPUB (electronic publications), social media, campaigns, subscriptions, mobile apps, all the digital or printed platforms in general.
The Font or Font Software is specifically the typographic product given with the current license, which was designed exclusively by BT and for all purposes is named The Font.
Common provisions for free and/or purchased licenses: The Licensee is not entitled to copy, distribute, or make available the Font Software to third parties for use of its purposes or for purposes other than those covered by this Agreement.
It is not permitted to sublicense, transfer, sell, lend, or lease the Font Software to third parties so that they can access and use it, except where authorized by applicable provisions of each license.
It is forbidden to modify, convert, translate, reverse engineer, decompile, disassemble, or attempt to discover any source code of the Font Software, except in the cases explicitly provided for in this Agreement and the USE definition. If you wish to make changes to the Font Software, you must obtain a previous written consent of Bastarda Type.
Licensee may back up the fonts for archive purposes only, provided that it retains sole custody and control over such copies. Any backup copies of the Font Software must be reproduced with the same copyright, trademark, proprietary and restricted rights as the original.
Licensee may provide a copy of the font to Bastarda Type along with its documents to the print shop or printer to send for printing any document, provided that it is informed about the use restrictions of the current license to the printer. The current license allows to embed fonts within your documents
to view, edit and print documents. You can also include the fonts you purchased with the purchase of this license in any file that the technological advance allows embedding for distribution and display of images to other sites.
It is forbidden to modify, convert, reverse engineer, decompile, disassemble, and/or use the original Font Software to create derivative or modified products without prior written consent of Bastarda Type.
Bastarda Type reserves all rights not specifically granted in the license. The duration of this license is perpetual.
If you are purchasing a free font, Bastarda Type grants the licensee solely and exclusively the use of (∞) users, and (∞) devices, which may be connected to any number of printers or other imaging devices (regardless of resolutions) on your own site. This license allows you to embed fonts within your documents to view, edit and print the documents, as well as embed in a web page if required.
If you are purchasing a paid font, Bastarda Type grants the licensee only the non-exclusive and non-transferable right to use and display the font purchased through the website http://bastardatype.com up to the users indicated in the following chart and the same number of devices which may be connected to any number of printers or other imaging devices (regardless of the resolutions) on your own site as well as on your website. If you are using this product for your work, this agreement applies to your employer and/or contractor, all depending on the package you purchased in the purchase:

The purchased font and accompanying materials, whether free or paid for, are copyrighted, and contain Bastarda Type confidential information and business secrets. Disclosure, reproduction, transformation, modification, alteration,
publication, sale, concession, copying, negotiation, delivery, transfer and/or disposal is not authorized by Bastarda Type is prohibited, even if modified, merged, or included with other software or written materials. You may be held legally liable
for any infringement of Bastarda Type’s intellectual property rights that is caused or encouraged by your breach of the terms of this license.
You may make one (1) copy of the purchased typeface for backup purposes only, provided that all copyright and trademark notices are reproduced in full in the backup.
Bastarda Type may update autonomously the Font Software. Upgrade prices can be applied on the sales platforms.
The Software and the accompanying materials are provided without warranty of any kind, expressed or implied, and the Licensee agrees to receive such goods as delivered. Bastarda Type shall not make any kind of adaptation for a particular and commercial purpose without prior discussion with BT. The total risk in terms of the quality and performance of the acquired software lies with you. Bastarda Type does not guarantee that the contained functions in the software comply with your requirements or that the operation of the software will not be interrupted or there will not be any error. Bastarda Type shall not be liable for any direct, indirect, consequential, or incidental damage (including loss of business profits, business interruption, loss of business information, etc.) arising from the use or inability to use the software.
You agree to inform all users who have access to the Font Software about the content of this Agreement and to ensure that they comply with the terms of this Agreement.
This Agreement can only be amended in writing and signed by the authorised person of Bastarda Type.
This Agreement shall be governed by the United Nations Convention on Contracts for the International Sale of Goods (CISG). If any part of this agreement is deemed null and void, it shall not affect the overall validity of the Agreement, which shall remain valid and enforceable in accordance with its terms.
Este Acuerdo de Licencia de Usuario Final (EULA) regula el uso de las fuentes tipográficas de Bastarda Type. Al descargar, instalar o usar una fuente, usted acepta los términos de esta licencia entre usted (o la entidad que representa) y Bastarda Type S.A.S. Si no está de acuerdo con estos términos, por favor no descargue ni utilice las fuentes.
Software de la Fuente implica el software en código fuente que acompaña este acuerdo y genera diseños tipográficos al utilizar el hardware y software adecuados.
Uso se refiere a cualquier actividad destinada a reproducir el Software de la Fuente o la familia tipográfica adquirida. Usted obtiene el derecho de integrarlo en computadoras de escritorio, sitios web, servidores, EPUB (publicaciones electrónicas), redes sociales, campañas, suscripciones, aplicaciones móviles y, en general, en todas las plataformas digitales o impresas.
La Fuente o el Software de la Fuente se refiere específicamente al producto tipográfico suministrado con la presente licencia, diseñado exclusivamente por BT y denominado para todos los efectos como La Fuente.
Disposiciones comunes para licencias gratuitas y/o de pago: El Licenciatario no está autorizado a copiar, distribuir ni poner a disposición el Software de la Fuente a terceros para su uso o para fines distintos a los establecidos en este Acuerdo.
No está permitido sublicenciar, transferir, vender, prestar o arrendar el Software de la Fuente a terceros para que puedan acceder y utilizarlo, salvo cuando lo autoricen las disposiciones aplicables de cada licencia.
Se prohíbe modificar, convertir, traducir, aplicar ingeniería inversa, descompilar, desensamblar o intentar descubrir el código fuente del Software de la Fuente, excepto en los casos expresamente previstos en este Acuerdo y en la definición de USO. Si desea realizar cambios en el Software de la Fuente, deberá obtener el consentimiento previo y por escrito de Bastarda Type.
El Licenciatario podrá realizar copias de seguridad de las fuentes únicamente con fines de archivo, siempre que conserve la custodia y el control exclusivos sobre dichas copias. Todas las copias de respaldo deberán reproducir los mismos avisos de derechos de autor, marcas registradas, derechos de propiedad y restricciones que el original.
El Licenciatario podrá proporcionar una copia de la fuente a Bastarda Type junto con sus documentos a la imprenta o impresor para la impresión de cualquier material, siempre que se informe al impresor sobre las restricciones de uso de la licencia vigente. La presente licencia permite incrustar las fuentes en documentos para su visualización, edición e impresión. Asimismo, permite incluir las fuentes adquiridas en cualquier archivo que los avances tecnológicos permitan incrustar para la distribución y visualización de imágenes en otros sitios.
Se prohíbe modificar, convertir, aplicar ingeniería inversa, descompilar, desensamblar y/o utilizar el Software de la Fuente original para crear productos derivados o modificados sin el consentimiento previo y por escrito de Bastarda Type.
Bastarda Type se reserva todos los derechos no otorgados expresamente en la licencia. La duración de esta licencia es perpetua.
Si adquiere una fuente gratuita, Bastarda Type concede al Licenciatario el uso exclusivo para (∞) usuarios y (∞) dispositivos, los cuales podrán conectarse a cualquier número de impresoras u otros dispositivos de reproducción de imágenes (independientemente de su resolución) dentro de su propio entorno. Esta licencia permite incrustar las fuentes en documentos para visualizarlos, editarlos e imprimirlos, así como integrarlas en una página web cuando sea necesario.
Si adquiere una fuente de pago, Bastarda Type concede al Licenciatario un derecho no exclusivo e intransferible para utilizar y mostrar la fuente adquirida a través del sitio web http://bastardatype.com, hasta el número de usuarios indicado en la siguiente tabla y el mismo número de dispositivos, los cuales podrán conectarse a cualquier número de impresoras u otros dispositivos de reproducción de imágenes (independientemente de su resolución), tanto en su propio entorno como en su sitio web. Si utiliza este producto para su trabajo, este acuerdo se aplicará a su empleador y/o contratista, según el paquete adquirido.

La fuente adquirida y los materiales que la acompañan, ya sean gratuitos o de pago, están protegidos por derechos de autor y contienen información confidencial y secretos comerciales de Bastarda Type. Queda prohibida su divulgación, reproducción, transformación, modificación, alteración, publicación, venta, concesión, copia, negociación, entrega, transferencia y/o disposición sin autorización de Bastarda Type, incluso si ha sido modificada, fusionada o incluida con otro software o material escrito. Usted podrá ser legalmente responsable por cualquier infracción de los derechos de propiedad intelectual de Bastarda Type causada o facilitada por el incumplimiento de los términos de esta licencia.
Se permite realizar una (1) copia de la tipografía adquirida únicamente con fines de respaldo, siempre que se reproduzcan íntegramente los avisos de derechos de autor y marcas registradas.
Bastarda Type podrá actualizar de manera autónoma el Software de la Fuente. Los precios de actualización podrán aplicarse en las plataformas de venta.
El Software y los materiales que lo acompañan se proporcionan sin garantía de ningún tipo, expresa o implícita, y el Licenciatario acepta recibirlos en las condiciones en que se entregan. Bastarda Type no realizará adaptaciones para fines comerciales o específicos sin previa discusión con BT. El riesgo total en cuanto a la calidad y el rendimiento del software adquirido recae en el usuario. Bastarda Type no garantiza que las funciones del software cumplan con sus requisitos ni que su funcionamiento sea ininterrumpido o esté libre de errores. Bastarda Type no será responsable por daños directos, indirectos, consecuentes o incidentales (incluyendo la pérdida de beneficios comerciales, interrupción del negocio o pérdida de información comercial) derivados del uso o de la imposibilidad de utilizar el software.
Usted se compromete a informar a todos los usuarios que tengan acceso al Software de la Fuente sobre el contenido de este Acuerdo y a garantizar el cumplimiento de sus términos.
Este Acuerdo solo podrá modificarse por escrito y con la firma de una persona autorizada de Bastarda Type.
El presente Acuerdo se regirá por la Convención de las Naciones Unidas sobre los Contratos de Compraventa Internacional de Mercaderías (CISG). Si alguna parte de este Acuerdo se considera nula o inválida, ello no afectará la validez general del mismo, que permanecerá vigente y exigible conforme a sus términos.
